Article 1, Identity of the seller

Orders are packed and shipped on behalf of the seller by its partner warehouse Shots in Beverwijk, the Netherlands. The seller remains your contracting party for everything related to your order.

Article 2, Applicability and age
These terms apply to every offer of MARROYSTOYS S.L. and to every distance contract concluded between the seller and a consumer. The webshop and its products are intended exclusively for persons aged 18 or over, or the minimum legal age in your country. By remaining on this website you confirm that you are at least 18 years old, and by placing an order you confirm this again. If you are under 18, please leave the website.

Article 3, The offer
Offers contain a complete and accurate description of the products, including material and the sizes that matter. Images are a true representation of the products; minor differences can occur through screen settings, packaging updates or manufacturer changes. Obvious mistakes or errors in an offer do not bind the seller.

Article 4, The contract
Submitting an order is an offer to purchase; the contract is concluded when the seller confirms the order electronically. The seller may refuse or cancel an order when a product is unavailable, payment is not authorised, order details cannot be verified, delivery to the destination is not possible, or an obvious pricing or description error occurred. Any amount already paid for a cancelled order is refunded. The seller takes appropriate technical and organisational measures to secure electronic payment and data transfer.
Before confirming, the consumer can review the order on the checkout page and correct any input error. The contract is concluded in the language of the website version used for the order. The seller stores the order and sends a confirmation with the order details by e-mail; the order can be viewed afterwards in the customer account or with the order lookup.

Article 5, Prices and payment
All prices are in euros and include VAT at the rate that applies to the order: Spanish VAT (IVA), or the VAT rate of the consumer's EU country where the EU rules on distance sales require it. The product price, VAT, shipping cost and total are shown before the order is confirmed. Prices are not increased during the validity period stated in the offer, except for changes resulting from VAT rates. Orders delivered outside the European Union may be subject to import duties, taxes or customs charges of the destination country; unless stated otherwise at checkout, these are for the recipient.
Payment is made through the secure methods offered at checkout and must be authorised before the order is processed. PayPal and Klarna are subject to the terms of those providers, and Klarna may carry out its own identity or credit check. An order paid by bank transfer is shipped once the payment has arrived; unpaid orders are cancelled automatically.

Article 6, Delivery
The seller delivers to the countries offered at checkout. Orders are shipped from the partner warehouse in the Netherlands; orders placed on working days are normally dispatched within 1 to 2 working days, and are delivered at the latest within 30 days, unless a longer delivery period was agreed. The consumer is responsible for providing a complete and accurate delivery address and a phone number the carrier can use. If delivery is delayed or cannot be fulfilled, the consumer is informed and may dissolve the contract free of charge and receive a full refund. The risk of damage or loss rests with the seller until the moment the consumer, or a person designated by the consumer other than the carrier, receives the products.

Article 7, Order changes and cancellation
Contact info@gaysteel.eu as soon as possible to change or cancel an order. Changes cannot be guaranteed once the order has been dispatched.

Article 8, Legal right of withdrawal (14 days)
The consumer has the legal right to withdraw from the contract within 14 days without giving any reason. The withdrawal period ends 14 days after the day on which the consumer, or a third party other than the carrier designated by the consumer, takes physical possession of the products; for an order delivered in several parcels, 14 days after receipt of the last parcel. During this period the consumer handles the product and packaging with care and only unpacks or handles it to the extent necessary to establish its nature, characteristics and functioning. The consumer is only liable for any diminished value of the product resulting from handling beyond that.

Article 9, Extended return period (30 days)
On top of the legal right of withdrawal, the seller voluntarily extends the period to 30 calendar days from receipt. The extension follows the same procedure and refund rules as the legal right of withdrawal; for a return announced after the 14th day, the product must also be unused, complete and in its original brand packaging. This commercial promise never limits the legal right of withdrawal or any other mandatory consumer right.

Article 10, Exceptions to withdrawal
For reasons of health protection and hygiene, sealed products that are not suitable for return once the seal or protective packaging has been broken after delivery are excluded from the right of withdrawal and from the extended return period. This does not affect the consumer's rights when a product is faulty, damaged or not as described.

Article 11, Exercising the right of withdrawal
To withdraw, the consumer informs the seller of the decision by an unequivocal statement, by e-mail to info@gaysteel.eu or by post to the address in Article 1. The consumer may use the model withdrawal form below, but this is not obligatory. It is sufficient to send the statement before the period has expired. The seller confirms receipt without delay and sends the return instructions and return address, normally within one working day. The consumer sends the product back without undue delay and at the latest within 14 days of the withdrawal statement, or of receiving the return instructions if that is later, with all supplied accessories and, where reasonably possible, in the original condition and brand packaging. The consumer bears the direct cost of returning the product, unless the return results from an error of the seller.

Article 12, Refund
The seller refunds all payments received from the consumer, including the standard delivery cost, without delay and at the latest within 14 days after being informed of the withdrawal. Extra costs of a delivery option more expensive than the cheapest standard delivery offered are not refunded. The refund uses the same payment method as the original transaction, unless expressly agreed otherwise; the consumer pays no fees for it. The seller may withhold the refund until the product has been received back or the consumer has supplied proof of having sent it back, whichever is earlier.

Article 14, Conformity and legal guarantee
The seller guarantees that the products comply with the contract, the description in the offer and the legal conformity requirements. Under Spanish law, which governs the contract, the legal guarantee for a lack of conformity is three years from delivery (Article 120 of the Spanish consumer protection act, TRLGDCU), and never less than the mandatory guarantee of the consumer's country of residence. In case of a lack of conformity the consumer may choose repair or replacement, and where that is impossible, disproportionate or unsuccessful, a price reduction or termination of the contract. Any manufacturer warranty comes on top of the legal guarantee and does not limit it.

Article 15, Product use and safety
The consumer reads and follows the instructions, warnings, care information and age restrictions supplied with a product, and uses products only for their intended purpose. Steel toys, chastity devices, urethral sounds, electro-stimulation and restraint gear require correct sizing and care.

Article 16, Website use and intellectual property
The website may not be misused, interfered with or accessed without authorisation, and may not be used to submit unlawful material or for fraudulent activity. Texts, images, logos and design are protected by intellectual property rights and may not be reproduced or used commercially without permission.

Article 17, Liability
Nothing in these terms excludes or limits liability that cannot legally be excluded, such as liability for death or personal injury caused by negligence, for intent or gross negligence, or under product liability law. To the extent permitted by law, the seller is not liable for indirect loss arising from misuse of products, unauthorised website use or circumstances outside its reasonable control.

Article 18, Complaints
Complaints about the performance of the contract must be submitted fully and clearly described to info@gaysteel.eu, or by post to the address in Article 1. The seller acknowledges every complaint and answers within 7 working days of receipt; if handling takes longer, the consumer receives an indication of when to expect an answer. Official complaint forms (hojas de reclamaciones) are available on request. Reporting a fault within the complaint period does not shorten the legal guarantee in Article 14.

Article 19, Disputes and applicable law
Contracts between the seller and the consumer are governed by Spanish law, without prejudice to the mandatory consumer protection provisions of the consumer's country of residence within the EU. A consumer may bring proceedings in the courts of their own country of residence. If a complaint cannot be resolved together, the seller informs the consumer in writing whether it will take part in an alternative dispute resolution procedure. Consumers can also turn to the consumer authority or the European Consumer Centre of their country; an overview of dispute resolution bodies is available at consumer-redress.ec.europa.eu.

Article 20, Changes
The seller may update these terms when its services or legal requirements change. The version in force when an order is placed applies to that order.
